On Monday, Fouad would have been twenty nine years old, and presumably enjoying his new found career as a real estate salesman. He would still be the loving son, brother, friend, and human being that so many here have reported about.

That did not happen. Instead, he was cruelly tortured and murdered by the fascist tools of the corporate state, Officer Bergin (Sandy Police) and Deputy Willard (Clackamas County Sheriff.

On September 6, 2005, Fouad was driving his parent's car, apparently carrying gasoline to his pickup truck, which had run out of gas. It was a hot day, and we think that he was clad only in shorts. At some point in this trip, something went dreadfully wrong. Initial reports indicate that Fouad was involved in a rear end collision with a car being driven by a Ms. Tiffany Stanko. From some witness' accounts, he may have already had a fire inside the vehicle, or it may have combusted when he struck Ms. Stanko's car. At any rate, he did not stop, as he may have been otherwise engaged (people who are on fire sometimes do strange things). Ms Stanko started the law enforcement gang rolling with her cell phone cries for help. Meantime, Fouad was still careening down the rural highway, and struck a couple more cars, before running off the road and bailing out, tearing what little clothing remained from his body, while fleeing the flaming car, which was a total wreck.
Here, a "coincidental" thing happened: Ms Stanko's uncle, who was working on a survey crew nearby, chased Fouad into the woods with a baseball bat. According to him, he caught up to Fouad, and tried to grab him, but since Fouad's skin was burned and peeling, and he was bloody, he lost his grip as Fouad kicked out at him. Fouad fell to the ground at that point, then rose, and continued to run, through the woods, apparently hysterical with pain.

By this time, there are countless first responders in the area, including an ambulance, a couple of fire rigs, and multiple agency police. Enter our two heros: Willard, who a few moments ago was many miles away, finishing part of his lunch and trying to decide whether to have his power bar or his afternoon prayer, and Bergin, a rookie in Sandy, who was also headed for lunch when he heard the calls for aid. Upon arrival in the area, Willard removed his shotgun from his patrol unit, and took off like Rifleman, through the woods, presumably to bag an elk or something similar. Unable to see the victim (Fouad IS the victim), he returned to the safety of the street, when Bergin came screaming up in his patrol car. About this time, a witness came by, saying that they saw a badly bleeding naked man, about a quarter mile up the road from where this assembly of first responders were congregated. Of course, Willard leaped into Bergin's car, and they screamed off like Batman and Robin, in hopes of being first to "bag" this helpless victim.
When they arrived, according to both officers, Fouad was "seated, Indian style (cross legged), naked, bleeding, with skin hanging from his body, rocking back and forth, in a catatonic state, and moaning." Seeing that Fouad was unarmed, and obviously injured, Willard said and did the only intelligent thing that he did in the entire encounter, he "transitioned to less lethal force (taser), and put down his shotgun. Of course, he had another brain lapse at this point (shoulda had the power bar), he tossed the loaded shotgun onto the hood of Bergin's car, and both officers draw their electric torture tools, and advance upon the victim (catatonic, seated, naked, bleeding, injured, etc.), yelling in typical "Cops" style (can't you just hear them?) for him to prone himself on the hot pavement. When he did not comply with these ridiculous demands, Bergin began tasering him, and continued until his toy ran out of electricity. Then, because the victim was writhing in pain, and they had no idea what to do with him (obviously, the idea of first aid never occurred to them), Willard similarly discharged his taser until empty.

Fouad, when added pain of the tasers ceased to torture him momentarily, did the only thing anyone would do in such a state, he fled the pain givers, and climbed to the highest refuge that he could find, the top of the patrol cars.

The protectors of the public peace had by this time decided (according to their statements) that there was no way that they could allow Fouad to leave, and yet, that there was also no way that they would allow him to touch them (all that icky blood and skin and stuff), so they had no choice. They shot him seven times, and at some point in this homicidal action, Fouad's young life was terminated.

Because of these fine individual's insensitivity to the agony that the victim was suffering, and their unwarranted fear of blood (first responders?), Fouad's family and friends must now SUFFER through his birthday, rather than celebrate it.

Please take a moment to share their pain, and to consider what has brought us to the state we are now in, where such egregious actions were not even condemned by a grand jury, led by the District Attorney, mentioned above. How will you be treated, if ever you are injured, bleeding, and burned?

A quick search of Indy, using Fouad's name will bring up past entries, for those who have just joined us.

Sorry we couldn't get you what you wanted: Justice.
We won't stop trying, not for you or anyone else lost to these murderous cowards.

Maybe not justice, but retribution is on it's way 05.Jan.2007 16:16

Justice is not possible, once the victim is dead, he is dead. For the living, retribution is an option, and I believe that the Spence Law Firm and Gerry Spence will reap a great deal of retribution on these thugs and their owner/handlers. Wrongful retention is just as actionable as the wrongful killers. I would like to say that Foote, too will see retribution, but DAs are immune, except at the ballot box, where I hope there are enough enlightenned folks to pass a sentence upon him.
In a system where a ham sandwich can be indicted, a DA that could not indict these murderers is not qualified to hold the job.

Retribution 05.Jan.2007 17:31

Yes LN! Retribution, accountability, acknowledgement of their errors... while these will not bring Fouad back and are an imperfect sort of justice, they are worth fighting for nonetheless. Perhaps more importantly, this will hopefully be the first step toward change, and others will not have to suffer through such injustice.

To Fouad's family and friends:
I'm so sorry for the pain you must be feeling especially as this day arrives. Know we are with you, in our hearts and our thoughts and we have not forgotten. I can't speak for the rest, but I know I'm eagerly awaiting your day in court. We all owe you a debt of gratitude for pursuing what must be this painful course of action - you fight for us all.

Coincidentally, Gerry Spence's birthday is the same day as Fouad's. I take that as a hopeful sign. The world certainly moves in mysterious ways.

Happy Birthday Fouad 07.Jan.2007 15:15

If I could only find the words to place with this somber anniversary...sixteen months later. Time will never heal the pain nor ease the suffering it will only remind us of this hanious crime and tragedy that has infected our community. Starting with Tiffany Stanko and her cowboy family to the murderous criminals and every other person leading to Fouads death will continually recognize their lethal part they played. The pain, torture and confusion that Fouad must have gone through before he fell to his death only makes me cringe with disgust. I truly believe in karma and revenge, if not on a physical level then a energetic sub conscious level that will eat and attack all involved in the killing of Fouad. It is a grand shame that Deputy Willard and officer Bergin are not behind bars, stripped of their freedom, rights and guns. They are parasites that contaminate the very good in anything. I hope the guilt and shame we all bestow upon them eats through what is left of their conscious mind.

Happy Birthday and Justice too !!! 09.Jan.2007 13:08

Teresa Teater

I sent Dear old Gerry Spence and the Firm a Christmas Card and even more evidence of what goes on in this stupid money grubbing county !!!
And signed it by saying....
Get allllllllll the Bastards in Clackamas County !!!!

Just so you know,The Kaady family will be well taken care of,
The Spence Law Firm, along with the Local Attorney that The Kaady Family used is still (thankfully)on the Federal case ,They filed the lawsuit in U.S. Federal Court...
And when I went to the federal courthouse in Portland and pulled up the Kaady case in the Clerks office, it showed that Clackamas County isn't smart enough to fight it's own battle, they hired a law firm in Michigan to help them out....
one of the blue collar crime laywers,(but I already knew, when even one of the County employee's I once knew, told me that the one certain county Attorney could'nt find his way to the Bathroom...more or less take care of Clackamas County trouble.
Now those of you that are way younger than Me, you go find the DVD movie True life story, called "The Karen Silkwood Story"...Gerry is portrayed in that Movie as Karen Silkwoods attorney ( Played by CHER ) whom finds out that her son's birth defects are from the plutionum rods that she made everyday while working for the ARCO (yes , the gasoline people) corporation.

I was so lucky to have watched Gerry in action last year in that Federal courthouse RE : Portland FBI/ Mayfield Case....Gerry is not done yet with that case...The Patriot act still has to be decided by U.S.Federal Judge ANN ANKEN.

The discovery deadline was yesterday for both side to share evidence in the Kaady case...in case anyone wants to know..

P.S 09.Jan.2007 13:38

God I feel old...I was born in April that year...I'm 50 this year.....

Oregon Senator Winters,

Subject:: WE THE PEOPLE, request you reject to confirm Interim-Deputy-Superintendent Tim McLain of Oregon State Police if Governor Kulongoski selects him for the position of Superintendent for the following reasons:

Thank you in advance for your very serious consideration on this dire matter.

Tim Mclain-Interim Superintendent
Oregon State Police
Salem, Oregon

Superintendent McLain,

Subject: Working with OSP-Independent Citizens Review Board

As you and Colleen are aware I gave her a message by telephone for you to answer one question, will you be working with our organization if you are selected and confirmed as the next superintendent? I also left two telephone messages on your office phone and cell phone and you have failed to reply to all three calls. This is the start of a pattern not unlike former Supt. Ruecker's failure to communicate with us to protect all Oregonians from out of control Law Enforcement Officers when witnessed by other Law Enforcement Officers.

If you don't respond to this e-mail ASAP we will send documents to the governor, attorney general and all state senators that you decided as Supt. Ruecker to allow the status quo to continue with huge law suits that will further drain the funds to operate an effective Law Enforcement agency.

When you were sworn into protecting people was it also just for protecting the old boys club as Supt. Ruecker must have believed?

Awaiting your most important reply as your career is at stake on this issue.

P.S. In the fall of 2005 because of the Kaady Killing we called the top official for training for Oregon State Police Lt. Douthit and asked him what is requred of a witnessing officer when an officer repeatedly is beating/kicking a restrained person? I replied what good would that do if the person is maimed for life or dies? Not until I said we will form an oversight board to have you change procedures did Lt. Douthit say he will take two steps to get it changed.

Eight months later state legislators gave pressure to the governor to force OSP Superintendent Ron Ruecker to send use their code of conduct that had NO change, NO new training set-up and NO new reporting, to our oversight board as we requested with many certified letters.

Supt. Ruecker resigned as of Dec. 1, 2006 as he stated for the betterment of members, my family and Oregonians.

What happens in OREGON goes NATIONWIDE.

Only LOVE will prevail,
